Welcome to SEEK A-List Party Patroller at the 2010 ARIA Awards.
SEEK A-List Party Patroller at the 2010 ARIA Awards is an interactive web portal that allows members to upload an application, view applications, vote and comment on applications presented on the website ("the service"). Members can also vote for the finalists for the SEEK A-List Party Patroller job to win tickets to attend the 2010 Aria Awards in Sydney.
By using the service you agree to be bound by the following terms and conditions:
- Capacity and Access
- To use the service you must be over the age of 18 years, or if you are under the age of 18 you must obtain a parent or guardian's consent.
By accessing the service you warrant that you are over 18 or have obtained a parent or guardian's consent. SEEK accepts no responsibility for users who have falsely provided information to access this service.
- You must be a registered user of Facebook to gain access to this service. To login to the service you must sign in with your Facebook user name and password.
- By accessing and using the service you agree and warrant to SEEK that you will comply with the Facebook terms of use.
- Privacy
- Your privacy is important to us. SEEK has its own Privacy Policy which explains how we collect and use personal information you provide to us. Please read the Privacy Policy and also the SEEK A-List Party Patroller at the 2010 ARIA Awards Privacy Statement below.

- The first time you login to the service, you will be asked to confirm your email address, provide your full name, date of birth and the state you live in. The personal information you provide when you login will be used for the purpose of:

- Enabling you to participate in the service, including without limitation interacting with your Facebook profile with information and updates about this promotion;
- Sending you information about SEEK if you subscribe to receive this information.
- SEEK may disclose your personal information to organisations which help SEEK support and maintain the service and may otherwise use and disclose your personal information as required or authorised by law.

- Any text (including without limitation comments), photographs, videos, images and other material ("Content") you post to the service will automatically become owned by SEEK, and you hereby assign all intellectual property rights in the Content to SEEK.
- You warrant and represent to SEEK that all Content you post to the service is original and does not infringe any third parties intellectual property rights, nor will result in SEEK being obliged to pay any royalty or licence fee.
- You agree to indemnify SEEK against any loss, damage or claim made in relation to any breaches of intellectual property rights arising from the publication of the Content. This includes legal costs for defending any such action (on a solicitor-client basis).
- Any Content you submit to the service must:
- Not constitute unauthorised commercial communication (such as spam);
- Not solicit login information, personal information or access to an account belonging to someone else;
- Not bully, intimidate or harass any other users;
- Not contain content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence;
- Not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content;
- Not use the service to do anything unlawful, misleading, malicious, discriminatory or defamatory;
- Not do anything that could disable or impair the proper working of the service; or
- Not facilitate or encourage any violations of these terms and conditions.
- SEEK reserves the right to remove immediately from the service any Content which SEEK deems in its sole discretion is contrary to clause 3.5, or is otherwise inappropriate for the SEEK A_List Party Patroller at the 2010 ARIA Awards website.
- When you post any Content it will become available for everyone to see, including people who are not members of SEEK A-List Party Patroller at the 2010 ARIA Awards.
- Any unauthorized use of Content, comments on blogs or other information displayed publicly on the SEEK A_List Party Patroller at the 2010 ARIA Awards website will be dealt with by SEEK, in the appropriate manner, including but not limited to initiating legal proceedings.
- Termination
- If you breach any of these terms and conditions, SEEK can stop granting you access to the service. SEEK will notify you by email or at the next time you attempt to access the service.
- You may choose to disconnect or disable access to the service at any time.
- The Service
- You use the service at your own risk. SEEK provides the service "as is" without any express or implied warranties including but not limited to implied warranties of merchantability, fitness for purpose and non-infringement. SEEK does not guarantee that the service will be safe or secure. SEEK is not responsible for the actions, content, information or data of third parties, and you release SEEK, its directors, officers, employees and agents from any claims and damages, known and unknown, arising out of or in any connection with any claim you have against any such third parties.
- Intellectual property
- All copyright, trade marks, designs ("intellectual property"), in and to the service including but not limited to the Content, compilation of Content and software are owned or licensed by SEEK.
- You must not use, copy, adapt, modify or alter any intellectual property owned or licensed by SEEK in any way whatsoever.
- Internet Delays
- The service may be subject to limitation, delays and other problems inherent in the use of the internet and electronic communications. SEEK is not responsible for any delays, delivery failures or damage resulting from such problems.
- Login to Facebook to access the service may be subject to limitation, delays and other problems inherent in the use of the internet and electronic communications. SEEK takes no responsibility for any delays, delivery failures or damage caused by Facebook in any way whatsoever.
- General
- These terms and conditions make up the entire agreement between you and SEEK in relation to the service and supersede any and all prior agreements.
- If any portion of these terms and conditions is found to be unenforceable, the remaining portion will remain in full force.
- SEEK reserves the right to modify, suspend or terminate the Service if it cannot be conducted in accordance with these terms and conditions, or due to circumstances beyond SEEK's reasonable control.
- Any dispute you may have in relation to these terms and conditions, must be made in writing and addressed to SEEK Brand Marketing, at the address of SEEK set out in clause 8.6.
- The laws of the state of Victoria, Australia apply to these terms and conditions. You submit to the exclusive jurisdiction of the Courts of the Commonwealth of Australia and Courts of Victoria.
- SEEK Limited (ABN) of 541 St Kilda Road, Melbourne, Victoria, Australia 3004 is the promoter of the service.
"SEEK A-List Party Patroller" PROMOTION 2010
HOW TO ENTER
To enter the competition you are required to submit a written application on www.arias.seek.com.au between 9am AEST on 24/09/10 and 5pm AEST on 15/10/10 outlining why you are best qualified to be the SEEK A-List Party Patroller together with a photo of yourself. Your application will then be voted on by registered members of the SEEK ARIA Award Promotion to arrive at a Short List of 20 potential candidates.
The final winner will be determined by a new round of public votes (50%) combined with the judges score (50%). In the event of a tie, the judges will determine the final winner.
TERMS AND CONDITIONS
- Information on how to enter and the prizes to be awarded form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian and New Zealand residents aged 18 years and over who can take the prize on dates to be advised by the Promoter from 01/11/10 to 10/11/10. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Only one entry in the promotion is permitted per person.
- If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the email account is held.
Promotion commences 9am AEST 24/09/10. Entries close at 5pm AEST on 15/10/10. Judging will take place at 541 St Kilda Road Melbourne 2004 on Monday 01/11/10.
- The Promoter's decision is final and no correspondence will be entered into.
- The Promoter will judge additional entries and record them in the order judged as "Reserves", in the case of an invalid Provisional Winner.
- The prize is a trip for one adult to attend the 2010 ARIA Awards in Sydney and be involved in reporting opportunities with Nova radio network, to be recorded in both Sydney and Melbourne. The prize is valued at up to AUD $5000 depending on point of departure, which includes a $1000 paycheck for the job as 'A-List Party Patroller ("Event Prize"). The Event Prize will take place on dates to be determined by the Promoter from 01/10/10 to 10/10/10. In order to be eligible to take the Event Prize, entrants must be able to take it at the specified time. The Event Prize includes:
- One economy flight from winner's nearest Australian capital city (if the winner is from Australia - if required) or from the nearest New Zealand capital city (if the winner is from New Zealand, which ever is closest) to Sydney departing between 05/11/2010 and 7/11/2010;
- One economy flight from Sydney to Melbourne departing on 08/11/2010;
- One economy flight from Melbourne to the winner's nearest Australian capital city (if the winner is from Australia - if required) or to the nearest New Zealand capital city (if the winner is from New Zealand, which ever is closest) departing between 08/11/2010 and 11/11/2010;
- Between three and five nights accommodation at accommodation TBA; total accommodation allocation limit will cover both Sydney for the Arias, and Melbourne for the radio drive time session with Nova.
- Return car transfers between airports and hotels;
- Chaperone at the ARIAs, working with the ARIAs PR team on the red carpet;
- A 2 hour media training session with NOVA radio network at your nearest capital city prior to the event;
- 1 x red carpet access at the 2010 ARIA awards;
- 1 x ticket to attend the 2010 ARIA awards;
- 1 x ticket to attend the 2010 ARIA awards official after party;
- Recorded video reporting session with Nova at the Arias to be played on Nova's website and the SEEK A-List Party Patroller website, www.arias.seek.com.au;
- Recorded audio reporting session with Nova at the Arias to be played on Nova stations the morning after the Aria's;
- One live on air discussion with Ryan, Monty & Whippa on Nova network and aired nationally;
- One paycheck for $1000; and
- 1 x grooming and styling package to the value of $1000.
Meals (other than the meals provided at the ARIAs), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Event Prize must be taken to coincide with the 2010 ARIA Awards event and is subject to booking and flight availability. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Event Prize. Event Prize is subject to the standard terms and conditions of individual prizes awarded and those of the relevant service providers. Winner may be required to present a credit card at time of accommodation check-in. The precise time and duration of the red carpet, awards event and after party to be determined by the Promoter and ARIA Awards 2010 officials, at their absolute discretion. All participants must follow the instructions of the Promoter and ARIA Awards 2010 officials whilst on the red carpet, at the awards event and at the after party.
- The following process will apply to awarding the Event Prize:
- All States/Territories: The Promoter will attempt to contact the Provisional Winner by email. He/she has until 5pm AEST on Tuesday 02/11/10 ("Claim Date A") to claim the Event Prize. If he/she is contacted prior to Claim Date A and is eligible he/she will receive the Event Prize. Otherwise, part (B) will apply.
- The Promoter may select Reserve Winners and attempt to contact the Reserve Winners by email, except if the Reserve is from SA, in which case part (C) will apply. If contacted and eligible, he/she will receive the Event Prize. If the Reserve cannot be contacted within 24 hours, or is contacted but ineligible, or cannot confirm eligibility within 24 hours; the Promoter will select the next Reserve Winner, and the same process as in this part (B) will apply until 5pm AEST on Wednesday 03/11/10 ("Claim Date B"). If the Event Prize is not awarded prior to Claim Date B, the process in part (D) will apply.
- SA residents: The Promoter will attempt to contact any SA Provisional Winner or Reserve Winner by email. He/she has until 5pm AEDST on Wednesday 03/11/10 ("Claim Date C") to claim the prize. If contacted prior to Claim Date B (see part (B) above), and is eligible, he/she will receive the Event Prize. If contacted but ineligible, or cannot confirm eligibility within 24 hours, then the Promoter will select another Reserve Winner, in accordance with part (B). If contact is made after Claim Date B but prior to Claim Date C, and he/she is ineligible, a prize of equivalent value will be awarded via the process in part (D), or if he/she is eligible a prize of equivalent value as determined by the Promoter will be awarded. If the Event Prize is not awarded prior to Claim Date C, the process in part (D) will apply.
- In order to award a Prize, as determined by the Promoter but of equivalent value to the Event Prize, a draw may take place at the same time and place as the original draw on Thursday 04/11/10, subject to any directions from a regulatory authority. The draw will exclude any ineligible Provisional Winners or Reserve Winners. Any winner will be notified by email and their name will be published in The Australian on Friday 05/11/10.
- In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
- Prizes, or any unused portion of the Event Prize, are not transferable or exchangeable and cannot be taken as cash. If for any reason a winner does not take the Event Prize or an element of the Event Prize at the time stipulated by the Promoter, then the Event Prize or that element of the Event Prize will be forfeited and will not be redeemable for cash. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the Event Prize has been booked, take the Event Prize or an element of the Event Prize at the time stipulated, then the Event Prize or that element of the Event Prize will be forfeited and will not be redeemable for cash.
- Total prize pool value is up to AU$5000 in Australia. The total prize pool value is up to NZ$6000 in New Zealand.
- If the Event Prize (or part of the Event Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Event Prize (or that part of the Event Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- The winner will participate in all activities at their own risk. The winner must: (a) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in activities forming part of the Event Prize; (b) not be under the influence of drugs or alcohol; and (c) comply with all directions of the Promoter and Event Prize organisers at all times; The Promoter and event organisers, in their absolute discretion, at all times reserve the right to: (a) prevent the winner from participating if, at any time, they reasonably believe that he/she poses a safety risk or for any other reason; and/or (b) cancel the activities, if the conditions are not met. If the red carpet, event or after party activities are varied for any reason beyond the control of the Promoter, they may not be rescheduled and no compensation will be offered.
- Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the Promoter's website is the entrant's responsibility and is dependent on the Internet service provider used.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2010 ARIA Awards event is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at the Prize Event.
- As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and event organisers in their absolute discretion, including but not limited to a legal release and indemnity form, for personal injury and death.
- The Promoter collects personal information in order to conduct the promotion. The Promoter may disclose such information to third parties, including but not limited to prize suppliers and Australian regulatory authorities, for the purposes of conducting the promotion, awarding the prizes, and as required by law, but otherwise will not share entrants' personal information with third parties. Entry is conditional on providing the information requested. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
- The laws of Victoria, Australia apply to this promotion to the exclusion of any other laws. Entrants submit to the exclusive jurisdiction of the courts of Victoria, Australia.

- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the Promoter's website is the entrant's responsibility and is dependent on the Internet service provider used.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2010 ARIA Awards event is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at the Prize Event.
- As a condition of accepting the prize, the winner and their companion must sign any legal documentation as and in the form required by the Promoter and event organisers in their absolute discretion, including but not limited to a legal release and indemnity form for personal injury and death.
- The Promoter collects personal information in order to conduct the promotion. The Promoter may disclose such information to third parties, including but not limited to prize suppliers and Australian regulatory authorities, for the purposes of conducting the promotion, awarding the prizes, and as required by law, but otherwise will not share entrants' personal information with third parties. Entry is conditional on providing the information requested. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
- The laws of Victoria Australia apply to this competition to the exclusion of any other laws. Entrants submit to the exclusive jurisdiction of the courts of Victoria, Australia.
